These Terms of Service apply to your use of our website and to purchases made from FOLIA. By accessing our website or placing an order, you agree to these Terms.

FOLIA sells alcoholic beverages and operates under South Australian liquor licensing requirements.

2. Age Requirements

FOLIA products contain alcohol and may only be purchased by persons aged 18 years or over.

By placing an order through our website, you confirm that:

  • you are at least 18 years of age;
  • the date of birth and other information you provide is accurate;
  • you are legally permitted to purchase alcohol; and
  • any person nominated to receive your order is at least 18 years of age.

We may request proof of age or identity where reasonably required.

Alcohol will not be knowingly sold or supplied to a person under 18.

3. Responsible Service of Alcohol

FOLIA supports the responsible consumption of alcohol.

We reserve the right to refuse or cancel an order where we reasonably believe fulfilling the order would breach applicable liquor licensing laws or conditions.

4. Products

We make reasonable efforts to ensure product descriptions, photographs, ingredients, alcohol content, pricing and other information displayed on our website are accurate.

Product packaging, appearance and other details may occasionally change.

Colours displayed on screens may also vary slightly from the physical product.

5. Orders

When you place an order, you are making an offer to purchase the products in your cart.

An order is not accepted until we have accepted and processed it.

We reserve the right to refuse or cancel an order where:

  • a product is unavailable;
  • pricing or product information contains an obvious error;
  • payment cannot be processed;
  • we reasonably suspect fraudulent activity;
  • we cannot legally supply or deliver the alcohol;
  • age requirements have not been satisfied; or
  • fulfilling the order would breach our liquor licence or applicable law.

If we cancel an order after payment has been taken, we will refund the relevant amount to the original payment method.

6. Pricing and Payment

All prices displayed on our Australian website are in Australian dollars (AUD) and include GST where applicable, unless otherwise stated.

Shipping or delivery charges are displayed separately where applicable and will be shown before you complete your purchase.

We may change prices, promotions and offers from time to time. Changes will not affect orders that have already been accepted.

7. Promotions and Discount Codes

Promotional offers and discount codes may be subject to additional conditions.

Unless otherwise stated:

  • promotional codes cannot be exchanged for cash;
  • only one promotional code may be used per order;
  • offers cannot be applied retrospectively to completed orders; and
  • promotions may be changed or withdrawn where permitted by law.

Any specific conditions advertised with a promotion will also apply.

Shipping and delivery are subject to our Shipping Policy.

You are responsible for providing complete and accurate delivery information.

FOLIA is not responsible for delays or failed deliveries caused by incorrect information supplied by the customer, subject to your rights under Australian Consumer Law.

Alcohol deliveries are subject to age and delivery requirements under applicable liquor licensing laws.

9. Returns, Refunds and Damaged Products

Returns, refunds, replacements and damaged deliveries are handled in accordance with our Returns & Refunds Policy and your rights under the Australian Consumer Law.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.

You agree not to:

  • use our website for unlawful or fraudulent purposes;
  • attempt to interfere with the operation or security of the website;
  • access the website using automated methods in a way that places an unreasonable load on our systems;
  • reproduce or commercially exploit website content without permission; or
